Examples of some of the more common employment-based visas include:

 

  • H-1B Visa (specialty) - Appropriate for foreign workers in a specialty field or occupation requiring theoretical or technical expertise.
  • H-2B Visa (seasonal), H2-A Visa (agricultural) - May be sought after the labor certification process has established no U.S. workers are available for the position.
  • O Visa (extraordinary ability) - For persons of extraordinary ability in the sciences, arts, education, business or athletics.
  • PERM Labor Certification - A permanent labor certification issued by the Department of Labor (DOL) allows an employer to hire a foreign worker to work permanently in the U.S. Individual PERM labor certification is a complex process involving numerous steps that must be completed within a specific time frame prior to filing the application.
  • E-1, Visa E-2 Visa (treaty traders, entrepreneurial investors) - Designed for treaty traders. The foreign national must be coming to the U. S. under a treaty of commerce and navigation that is in effect between the U.S. and the foreign national’s country.
  • J-1 Visa (visitors) - For foreign nationals on an exchange visitor program.
  • L Visa (foreign nationals) - Limited to foreign nationals who have worked for a company outside the U.S. for at least one year and whom the company wishes to bring to the U.S. temporarily to work in a managerial capacity or to provide specialized knowledge
  • P Visa (professional athletes) - For athletes or entertainment groups internationally recognized for their level of performance and who wish to come temporarily to the U.S. to perform.
